Introduction

Santor Edition is committed to an ongoing process of compliance with the General Data Protection Regulation of April 27, 2016. With this new regulation Santor Edition is strengthening its personal data protection policy to ensure that our users' data is collected and used in a transparent, confidential and secure manner.

Personal data protection policy as of May 25, 2018

This privacy policy describes how Santor Edition, the data controller, treats the personal data of users (hereinafter referred to as "Users") when they browse the sites and use the services and applications governed by Santor Edition and which point to this page when you click on the "Privacy Policy" link located at the bottom of the pages of the site or in the mobile application (hereinafter referred to respectively as the "Sites", the "Services" and the "Applications"). The Privacy Policy is an integral part of the General Terms and Conditions of Use of the Sites, Services and Applications.

Santor Edition pays constant attention to our Users' data. We may therefore modify, supplement or update the Personal Data Protection Policy in order to maintain compliance with the law and to take into account any changes to our data collection process. We invite you to regularly consult the latest version in force, accessible on our Sites and Applications. If major changes are made, we will notify you by email to allow you to review these changes before they take effect. Your continued use of our Sites, Services or Applications after we post or send you notice of changes to the Privacy Policy will mean that you accept the updates.

If you do not want us to collect and use your personal data as described in this Privacy Policy, you should not use the Sites, Services and Applications.

Personal data collected and purposes

The Sites, Services and Applications are intended for healthcare professionals. Some of the content is governed by various laws, notably articles L5122-1 to L5122-16 of the French Public Health Code, and access to such content must be restricted to a specific audience (doctors of a particular specialty practicing in France, for example). In order to comply with this legislation, it is necessary for us to collect sufficient personal data (such as identity, profession, specialty, practice address, practice authorization number, etc.) to identify users, verify their professional status and comply with these laws.

We also ask you to provide us with your e-mail address and, if necessary, your telephone number, as we may need to verify your information by telephone, send you a secure access code by SMS or e-mail, send you new access codes at your request, send you notifications, information about our Sites, Services and Applications, and newsletters from Scientific information or partners always in direct relation to your profession.

When you create your MediPass user account, we collect some or all of the following information in order to validate your access as a healthcare professional:

Surname, first name, email address, telephone number, date of birth, profession, specialty in the case of a doctor or intern, RPPS or other practice authorization number, place of practice (practice, hospital, etc.), establishment and department, zip code, city, country.

This information can be modified via the "My profile" page accessible on the various Sites, Services and Applications, and in particular on www.medipass.fr.

Also, for identification and statistical purposes, we may collect personal information (RPPS or other practice authorization number, place of practice, professional qualifications, etc.) available from public sources (such as websites) in compliance with the general conditions of use of said sources, as well as from trusted third parties.

Comments on articles posted by you are displayed on our Sites and Applications together with your first and last name, profession and place of practice. These comments are recorded and kept by Santor Edition for as long as the article to which the comment relates is online.

We also automatically collect information on your use of the Sites, Services and Applications, such as the content consulted or the Services used by you, the time and frequency of their consultation or use, the searches you have carried out, the newsletters and e-mailings you have opened, the links you have clicked, your answers to surveys, quizzes, clinical cases, questions to experts and other similar data, the technical characteristics, IP address and advertising ID of the equipment used to access the content, in order to provide you with content and a format adapted to your needs, to optimize our Sites, Services and Applications according to your use of said Sites, Services and Applications, to enable you to resume your browsing where you left off when you use a different equipment and to detect and prevent fraud.

Santor Edition offers, in its own name or on behalf of third parties, services and tools to users. In order to provide these services or to enable the proper functioning of these tools, it may be necessary for the user to provide other personal data. In such cases, a supplement to this privacy policy will be accessible from the pages or applications concerned. If the communication of personal data to a third party is necessary to provide the service or enable the tool to function properly, the user will be required to formally validate the transfer of said data.

With regard to promotional emails or scientific newsletters: You may withdraw your consent at any time by (i) unchecking the relevant box(es) in your account "Manage my newsletters" link, (ii) clicking on the unsubscribe link provided in each of our communications or (iii) by contacting us at privacy@santor.net. For technical reasons, our newsletters and promotional emails may not be stopped immediately. A maximum of 72 hours may elapse between your request and the cessation of mailings.

We collect the information you provide when:

  • Create, modify and access your personal account
  • You browse our Sites or use our Services or Applications
  • Fill in a contact form
  • Contact our Registration Department

Using mediPass on a third-party website

Your user account and personal data are stored on the mediPass system, which enables you to identify yourself on sites external to Santor Edition using your mediPass credentials. In this case, the only data shared with the third-party site is your profession, specialty, practice mode (e.g. liberal or hospital) and country of practice.

Sharing your data with third parties

The personal data collected from you on our Sites and Applications is intended for Santor Edition's own use and may only be passed on to sub-contracting companies that Santor Edition may use to perform its own services.

Under no circumstances will Santor Edition sell or rent your personal data to third parties without your express consent.

We also work closely with third parties who may have access to your personal data, in particular :

  • When we are legally required to do so, or if we believe in good faith that it is necessary to (i) respond to any claim against Santor Edition, (ii) comply with any judicial request, (iii) enforce any contract entered into with our members, such as the Terms of Use and this Privacy Policy, (iv) in the event of an emergency involving public health or the physical integrity of a person, (v) in the context of inquiries and investigations or (vi) in order to guarantee the rights, property and safety of Santor Edition, its members and more generally any third party;
  • In addition, Santor Edition will not disclose your personal data to third parties unless (1) you (or your account administrator acting on your behalf) request or authorize the disclosure; (2) the disclosure is required to process transactions or provide services that you have requested; (3) Santor Edition is compelled to do so by a governmental authority or regulatory body, in the case of a judicial requisition, subpoena or similar governmental or judicial requirement, or to establish or defend a legal claim; or (4) the third party is acting as an agent or subcontractor of Santor Edition in performing the services (for example, if Santor Edition uses the services of a telecommunications company).

If Santor Edition or all or part of its assets are acquired by a third party, the data in our possession will, where appropriate, be transferred to the new owner.

We store your data in the European Union.

Protection of your personal data

Santor Edition applies generally accepted technological and organizational security measures to ensure that personal data collected is not lost, misappropriated, accessed or modified by, or disclosed to, unauthorized third parties, unless disclosure of such data is required by law, in particular at the request of a judicial authority, the police, the gendarmerie or any other authority empowered by law.

The security of personal data also depends on Users. Users undertake to keep their login and password confidential. Users also undertake not to share their account and to notify Santor Edition of any unauthorized use of said account as soon as they become aware of it.

Personal data retention

Personal data communicated by Users of the Sites, Services and Applications will be deleted after a certain period and depending on the data processed.

  1. As regards users of our Sites, Services and Applications, with the exception of categories B and C set out below, your personal data will be deleted 3 years after your last connection to or use of one of our Sites, Services or Applications or after your last reading of an e-mail or newsletter from us. However, if we are informed of the termination of your professional duties or if you withdraw your consent to the processing of your personal data, your data will be deleted immediately.
  2. As regards authors of articles on our Sites and Applications, we retain your personal data for as long as the article(s) remain(s) published and as long as the legal deadlines for copyright and retention of commercial and accounting documents apply.
  3. For authors of article comments on our Sites and Applications, we retain the personal data displayed (surname, first name, profession, place of practice) as well as your e-mail address for as long as the article(s) concerned by the comment remain(s) published.

Processing of data concerning minors

As our Sites and Applications are intended for healthcare professionals, minors are not authorized to register and use the Sites, Services and Applications. We therefore do not collect data on minors.

Using Santor Edition services in connection with social networks

Your use of social networks and Santor Edition Sites or Applications in connection with social networks may result in the collection and exchange of certain data between the social networks and Santor Edition.

We are not responsible for the use made of your data by social networks on their own behalf. You can set and control access to and confidentiality of your data directly on the social networks.

What are your rights?

In accordance with current regulations, Users of our Sites and Applications have the following rights:

  • Right to access, rectify, update and complete User data;
  • The right to block or delete User data that is inaccurate, incomplete, ambiguous, out of date, or whose collection, use, communication or storage is prohibited;
  • The right to withdraw consent at any time;
  • Right to limit the processing of User data;
  • Right to object to the processing of personal data;
  • Right to portability of data provided by Users, where such data is processed automatically on the basis of their consent or a contract.

If you would like to know how Santor Edition uses your personal data, request rectification or object to processing, please send an e-mail to privacy@santor.net. Finally, Santor Edition users may lodge a complaint with the supervisory authorities, in particular the CNIL.

Your request will be processed within 30 days. In addition to your request, we will ask you to enclose a photocopy of proof of identity so that Santor Edition can verify your identity.

GENERAL INFORMATION ABOUT COOKIES AND OTHER TRACKING TECHNOLOGIES

This notice tells you how cookies and other tracking technologies work and why they are used. These technologies can inform us of several elements concerning you. This information is collected from your terminal equipment and will be used when you visit our sites.

TRACKER DETAILS

  • Tracers that are strictly necessary

    They are essential to the proper functioning of our Sites or Applications and allow you to use basic functionalities (for example: access to the private area, memorization of your choice in terms of consent). Without them, our sites will not be functional and your access will be very limited. We also use cookies to establish anonymous performance statistics for our Sites or Applications. These cookies cannot be deactivated, as they are essential to the proper functioning of the site. They enable us to meet various needs (performance measurement, detection of browsing problems, optimization of technical performance or ergonomics, estimation of server power requirements, analysis of content consulted, etc.).   • Trackers for targeted advertising
